MEP Chris Heaton-Harris has asked the Commission to look into UK drug distribution on the grounds that it breaks European anti-discrimination laws.
Mr Heaton-Harris is defending a patient who has been denied cancer drug Sutent by his local primary care trust, and is having to pay for the treatment himself.
The patient, Mr Jones from Rugby, Warwickshire, is currently paying GBP3,400 a month for his daily dosage of Pfizer's Sutent for the treatment of abdominal cancer.
Warwickshire PCT has denied that its decision to deny the drug was based on cost, although the drug is funded by other PCTs in the UK.
