EPA Deadline for Area Sources Rule Extended

SOCMA said it is unclear if EPA will use the additional time to reconsider establishing a de minimis threshold. SOCMA had earlier, urged EPA to establish a de minimis threshold for applicability and that the rule should only apply to chemical manufacturing process units that emit urban air toxics.

SOCMA will need additional time to discuss the case with EPA staff. SOCMA’s Environmental Committee will be discussing possible next steps in the wake of these developments.

This rule is said to have a significant economic impact on SOCMA members. SOCMA has been actively engaged on this issue since 2007, and argued against the proposed rule’s cost in comments submitted to the EPA earlier this year.
