Forest and Merz file lawsuits against generic firms over Namenda

Forest Laboratories Incorporated, Forest Laboratories Holdings Limited, Merz Pharma GmbH & Co KgaA and Merz Pharmaceuticals GmbH have filed lawsuits in the US District Court for the District of Delaware against several companies for infringement of a US patent that relates to Forest's Alzheimer's drug Namenda.

The defendants named in the lawsuits include Barr Laboratories, Cobalt Laboratories, Lupin, Orchid Chemicals & Pharmaceuticals, Teva Pharmaceuticals USA, Upsher-Smith Laboratories, Wockhardt and related companies and subsidiaries thereof.

The Namenda patent will expire in April 2010. Forest has applied for patent term extension which, if granted, would extend the patent until September 2013.
