Indian state drug-makers object new food safety act

Drug-makers in Gujarat, India, will move court against the new food safety act that have brought manufacturing of health supplements under central licensing.

Gujarat Chamber of Commerce & Industry, the apex trade and industry body, has filed a suit and the first hearing is slated for 23 August 2012. The Gujarat chapter of IDMA may file a separate suit in Gujarat High Court shortly.

The Union Health ministry has prepared the Food Safety and Standards Act, 2006, and implemented in 2011.

Drug makers with small units engaged in making food supplements object to a non-refundable fee of Rs25,000 for obtaining a mandatory no-objection certificate (NOC) valid for one year.

Indian Drug Manufacturers’ Association’s Gujarat Chapter chairman Chirag Doshi was quoted by Economic Times as saying that, "For small-sized companies, it would be a huge expense."

Various high courts in India have issued 17 stay orders on provisions of the act, which covers energy capsules, baby food, body-building drinks and popular health supplements given to growing kids, after the industry challenged them.
