It is vital that our clients obtain a robust legal title to their IP. To this end, we have extensive expertise in transactions involving IP rights.

We are highly experienced in evaluating title and preparing suitable agreements to ensure a robust legal title, whether by way of assignment or other legally effective transfer, licence, franchise or security.

We prepare and file transaction recordal applications in the UKIPO, the European Patent Office, OHIM and WIPO. In other jurisdictions, we work closely with trusted attorneys to satisfy local recordal requirements and ensure legally valid title. We also work with our clients and their commercial lawyers to provide expert IP support on commercial transactions being handled by others, from due diligence through advising on IP transaction documentation to recordal of the transactions.

Title disputes

We have expertise in the preparation of confidentiality agreements to protect the disclosure of information, particularly prior to filing suitable patent or design applications. We are also frequently consulted to resolve title disputes for our clients, which typically involves the negotiation and drafting of suitable settlement agreements.

We have considerable experience of restoring rights for our clients in the UKIPO and the EPO. For example, it is sometimes the case that a client will unintentionally fail to pay a renewal fee. We work closely with our clients to ensure that the best relevant evidence is obtained to satisfy restoration requirements in the various jurisdictions, frequently interviewing relevant witnesses ourselves and preparing or assisting in the preparation of suitable witness statements.
