Covidien files patent infringement lawsuit against Davol

Covidien, a provider of healthcare products, has filed a lawsuit in the US District Court of Delaware against Davol, a wholly owned subsidiary of CR Bard, relating to its mesh fixation device and applier.

The lawsuit contends that Davol’s recently released Sorbafix device infringes multiple claims of Covidien’s US patent.

The patent generally relates to a system for controllably discharging fasteners from an applicator. Covidien is asking the federal court to enjoin Davol from continuing to make and sell its Sorbafix device, as well as for compensatory damages.

Dave Motley, responsible for global surgical franchise and portfolio management at Covidien, said: “We will vigorously protect our intellectual property.”
