CoolTouch, a developer and manufacturer of advanced laser products, has reported that the Boston District Court has dismissed the Diomed lawsuit between CoolTouch and Endolaser Associates after CoolTouch signed a settlement agreement with Luis Navarro.

This patent infringement suit was originally filed in 2004 and relates to the use of lasers for endovenous ablation. CoolTouch will license the Navarro patent and pay royalties on CTEV laser sales and accessories that potentially allow vein wall contact with the emitting part of the fiber.
In another patent matter, CoolTouch, working with the Boston law firm of McCarter & English, has filed a re-examination request with the US Patent Office of the Paolini laser lipolysis patent assigned to Cynosure, which is the subject of litigation between the parties.
CoolTouch requests the re-examination based on prior art by David Apfelberg and by David Hennings. CoolTouch has filed for a stay in the litigation until the patent office rules on the validity of this patent.
